Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("Policy") sets out the specific rules of conduct for everyone who uses The Healthcare Portal (the "Platform") — Patients, Providers, Strategic Partners, and Institutional Partners. It operationalises, in practical detail, the general conduct obligations set out in our Terms & Conditions, which it supplements and does not replace. By using the Platform, you agree to comply with this Policy in addition to the Terms & Conditions and Privacy Policy.

We may update this Policy more frequently than the Terms & Conditions, to reflect new patterns of misuse or new Platform features, without that update constituting a "material change" to the underlying contract. Significant changes will still be posted with a visible update date.
2. General Conduct — All Users

Regardless of your role on the Platform, you agree to:

  • Provide accurate information about yourself, your organisation, your credentials, or your medical history, as applicable
  • Treat other users with respect — this is a healthcare platform, often used by people in a vulnerable or stressful moment
  • Use the Platform only for its intended purpose: facilitating legitimate medical, dental, and wellness care
  • Respect the intellectual property and confidentiality of information shared by other users
  • Comply with all applicable law in your own jurisdiction, not only where the Platform or the treating Provider is based
3. Rules by Role
Patients
  • Provide truthful medical history — inaccurate information can affect your safety, not just Platform accuracy
  • Attend confirmed appointments or cancel with reasonable notice
  • Do not submit false or exaggerated reviews
  • Do not use another person's identity to book treatment
Providers
  • Keep licensing, accreditation, and insurance documentation current and promptly notify us of any change in status
  • Represent treatment outcomes, pricing, and facility conditions accurately — see Section 4
  • Respond to enquiries and confirmed bookings within the response times set out in your Provider agreement
  • Do not solicit off-Platform payment for a Patient relationship first formed through the Platform, within the period set out in your Provider agreement
Strategic Partners
  • Represent your referral relationships and network model accurately during onboarding and ongoing use
  • Do not misrepresent Platform-sourced Providers as your own exclusive network where a Shared or Hybrid model applies
  • Maintain the confidentiality of patient data shared with you under your framework agreement
Institutional Partners
  • Use the institutional rollup dashboard and referral data solely for the purpose of coordinating your referred patients' care
  • Maintain the data-handling standards set out in your framework agreement's Governance & Compliance terms
  • Report suspected fraud or misuse within your own referring institution promptly
4. Content Standards for Provider Listings

Because this Platform facilitates medical decisions, listing content is held to a higher standard than a typical marketplace. Providers must not:

  • Use manipulated, staged, or non-representative before/after images, or images not genuinely from the listing Provider's own practice
  • Claim specific success rates, recovery timelines, or outcomes without a genuine, disclosable clinical basis
  • Describe a procedure, qualification, or facility capability the Provider does not actually offer or hold
  • Use pricing that is not genuinely available to Platform-referred Patients at the stated terms
  • Imply Platform endorsement of a specific clinical outcome — the Platform verifies credentials, not clinical results, as stated in our Terms & Conditions

[Note for legal review: advertising standards for medical and dental services are separately regulated in most countries — e.g., restrictions on before/after imagery for cosmetic procedures, or prohibited comparative claims. This section should be checked against advertising law in India and significant patient-origin countries, not only general marketplace-content principles.]

5. Messaging Conduct

Platform messaging between Patients and Providers exists to support the treatment journey. You must not use it to:

  • Send harassing, threatening, or abusive messages
  • Send unsolicited marketing unrelated to an active enquiry or booking
  • Share content unrelated to the medical consultation, including spam or links to unrelated services
  • Attempt to move the conversation off-Platform in a way that circumvents the protections described in Section 7
6. Review Integrity

Reviews and ratings help every user on the Platform make informed decisions, so we hold them to a genuine-experience standard. The following are violations:

  • Submitting a review for a treatment or consultation you did not genuinely receive
  • Offering or accepting payment, discounts, or preferential treatment in exchange for a positive review
  • A Provider submitting or arranging reviews for their own listing, or negative reviews for a competitor's
  • Review-swapping arrangements between Providers
7. Circumvention — What It Actually Looks Like

Our Terms & Conditions prohibit circumventing the Platform. In practice, this includes:

  • A Provider asking a Patient to complete payment via bank transfer, cash, or a third-party app instead of through the Platform, for a relationship first established here
  • Exchanging personal contact details through messaging specifically to move a booking off-Platform before it is confirmed
  • A Strategic Partner routing a Platform-sourced Provider relationship through a separate, undisclosed booking channel

This does not include exchanging contact details after a booking is confirmed for legitimate treatment coordination, which is expected and supported by the Platform.

As described in our Privacy Policy, we use automated pattern-detection, reviewed by our team, to identify likely circumvention attempts. A flagged message does not automatically result in enforcement action — see Section 10.

8. Prohibited Content

You must not post, upload, or send through the Platform any content that is:

  • Unlawful, defamatory, obscene, or discriminatory
  • In violation of another person's privacy, including sharing another Patient's identifiable health information
  • Malicious code, or content intended to disrupt Platform functionality
  • Infringing of a third party's intellectual property rights
9. Institutional and Strategic Partner Conduct

In addition to the role-specific rules in Section 3, Institutional Partners operating under a framework agreement must use referral data, the institutional rollup dashboard, and any secure communication channel with a treating hospital solely for coordinating the care of patients they have referred — not for unrelated commercial purposes, and not shared outside the personnel your framework agreement designates as authorised users.

10. How We Enforce This Policy

Enforcement decisions involve human review, particularly for AI-flagged circumvention patterns, and consider context and history rather than applying automatically. Providers, Strategic Partners, and Institutional Partners may also face consequences under their separate commercial agreement with us, in addition to Platform-level enforcement.

11. Reporting a Violation

If you believe another user has violated this Policy, report it through the in-Platform reporting option where available, or contact [trust@thehealthcareportal.com]. We review reports and, where appropriate, take enforcement action under Section 10. We will not disclose the identity of a reporting user to the party they reported, except where required by law.

12. Changes to This Policy

We may update this Policy periodically to address new patterns of misuse or new Platform features. Continued use of the Platform after an update takes effect constitutes acceptance of the revised Policy. Material changes affecting your legal rights will still be communicated as described in our Terms & Conditions.
